State-Level Digital Transformation Policy Scan: AI Legislation

In November 2024, the DSN expanded its digital transformation policy scan by documenting legislation related to artificial intelligence (AI) introduced across states and territories since 2019. This work expands on the executive order scan the DSN unveiled in 2023. 

 

The DSN identified 894 bills related to AI introduced since 2019 for this scan. 126 of those bills (14%) were enacted. These bills are compiled in an open database.

 

By seeking to regulate the way government does—or does not— use AI, legislation sets the stage for what is legal, ethical and equitable, and what is possible when considering the use of AI in designing and delivering public benefits and services. The AI legislation scan is a timely tool as government employees across the U.S. grapple with these essential questions about the role of AI in digital government work. 

 

State legislative sessions in 2025 are sure to be full of bills looking to shape the way government considers AI. Practitioners can expect the DSN to responsively update the legislative scan as these sessions unfold so that this resource becomes a go-to for exploring and understanding AI-related legislation across the U.S.
